The present General Terms and Conditions of Sale (GTC) apply to all sales of physical products made through the site https://www.lesmontagnardes.com.

Article 1 – Scope of application

The GTC apply to any order placed by a private customer, in France and in the European Union.

Any order implies full acceptance of these GTC.

Article 2 – Products

The products offered for sale are described with the utmost attention possible on their product sheet on the day of the order. The photographs are non-contractual and may show slight variations.

Some products are made from natural materials such as wood, linen, wool, or stone. Others are handmade, offered in limited series, numbered editions, or unique pieces (decorative objects, textiles, accessories, special editions).

As such, slight variations in shade, texture, grain, shape, or finish may exist from one product to another. These differences, inherent to the artisanal and natural character of the products, are an integral part of the product and cannot be considered defects.

The products are offered within the limits of available stocks. In case of unavailability after order validation, the customer will be informed as soon as possible and may choose between a refund or an exchange.

Some products can be made to measure or personalized at the customer's request (dimensions, colors, finishes, markings, choice of materials, etc.). The visuals, sketches, or descriptions provided in this context are for indicative purposes.

Article 3 – Maintenance and use of products

The products sold by LES MONTAGNARDES require maintenance and use in accordance with their nature.

LES MONTAGNARDES cannot be held responsible for deterioration resulting from inappropriate use, lack of maintenance, unsuitable storage conditions, or normal wear and tear related to use.

Article 4 – Prices

The prices are indicated in euros (€), all taxes included (TTC).

LES MONTAGNARDES reserves the right to change its prices at any time, without affecting already validated orders.

Article 5 – Order

The order is considered final after payment validation and sending of the confirmation email. This email serves as proof of the transaction and acceptance of these GTC, in accordance with article 1366 of the Civil Code.

For customized or made-to-measure products, production begins after complete validation of the order and, if applicable, written validation of the customer’s choices. Any modification requested after the start of production may lead to a delay in the announced timeframe or a refusal of modification.

Article 6 – Payment

The payment is made online by credit card via Stripe, a secure payment solution.

No banking data is stored by LES MONTAGNARDES.

Payment in installments with Alma

Payment in installments is offered exclusively online through the Alma solution. This payment method is subject to the acceptance of Alma's General Conditions.

Alma acts as a financing company and grants credit to the customer. By choosing payment in installments, the customer accepts Alma's contractual terms and benefits from consumer credit rights, in accordance with current regulations.

The payment is made online by credit card via Stripe, a secure payment solution.

No banking data is stored by LES MONTAGNARDES.

Article 7 – Delivery and production times

The products are delivered in France and in the European Union.

For products made to order, customized, made to measure, or in limited editions, a specific production time applies before shipping. This timeframe is indicated as an estimate on the product sheet or communicated upon order validation.

The delivery times do not include production time. A reasonable production delay cannot engage the responsibility of LES MONTAGNARDES as long as the customer is informed, within a maximum indicative production time of eight (8) weeks unless stated otherwise on the product sheet.

Article 8 – Right of withdrawal

In accordance with current legal provisions, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal. The refund includes, if applicable, standard delivery costs.

The products must be returned unused, in perfect condition and in their original packaging. Return costs are borne by the customer.

In accordance with article L.221-28 of the Consumer Code, the right of withdrawal does not apply to products made according to customer specifications or clearly personalized. Any customized or made-to-measure order is therefore firm and definitive.

Article 9 – Refund

The refund is made within a maximum period of 14 days after receipt of the returned products, via the initial payment method.

Article 10 – Legal warranties

The products benefit from the legal warranty of conformity and the warranty against hidden defects, in accordance with the provisions of the Consumer Code.

Article 11 – Retention of title

The products remain the property of LES MONTAGNARDES until full payment of the price.

Article 12 – Liability

LES MONTAGNARDES cannot be held responsible for indirect damages resulting from the use of the products sold. In any case, the liability of LES MONTAGNARDES is limited to the amount of the order, unless there is a mandatory legal provision to the contrary.

Article 13 – Force majeure

LES MONTAGNARDES cannot be held responsible for non-performance or delay in the performance of its obligations in the event of force majeure as defined by French jurisprudence, including but not limited to natural disasters, pandemics, administrative decisions, strikes, or transport disruptions.

Article 15 – Sale in physical store

The present General Terms and Conditions of Sale apply exclusively to sales made through the website https://www.lesmontagnardes.com.

Sales made in physical stores are subject to the conditions applicable in-store.

Article 16 – Consumer mediation

In case of a dispute that cannot be resolved amicably, the customer can refer free of charge to a consumer mediator.

Article 17 – Applicable law

The present GTC are subject to French law. In the absence of an amicable resolution, the competent courts will be those within the jurisdiction of Bonneville. If any clause of these GTC is declared void or unenforceable, the other clauses will retain their full force and effect.
